TEXT OF SB357 -Adult Protective Services – Vulnerable Adults Registry – Investigations and Records of Abuse and Neglect and Workgroup Study
Establishing certain requirements and procedures relating to the reporting, disclosure, investigation, and appeal of civil allegations and findings of abuse and neglect of vulnerable adults; authorizing the Social Services Administration to establish and maintain a centralized confidential database for abused and neglected vulnerable adults; establishing a Workgroup to Study Best Practices for a Vulnerable Adult Registry in Maryland; etc.

Service providers who commit abuse or neglect must be subject to appropriate disciplinary action, including removal from care-giving settings and/or criminal prosecution when appropriate. No registry of victims is necessary to take appropriate action to protect them.

Victims captured in this registry may not be adequately informed that their identity is being tracked in a database, or able to give informed consent to have their personal data captured and stored.

There is no way to ensure the privacy or security of the data captured in such a database; the data could be hacked, released, or sold in the future without adequate informed consent to those victims whose personal data was breached.
- Ultimately there is no way to ensure that any database of individuals will remain confidential in perpetuity.
