Private: ACTION ALERT: Please Ask Legislators to SUPPORT HB1045 Which Protects Employees from Discrimination or Dismissal for Refusing Certain Medical Procedures
TEXT OF HB1045 – Labor and Employment – Elective Medical Procedures – Employee Protections:
Prohibiting an employer from requiring an employee to undergo a certain medical procedure unless the procedure would have a substantial effect on the employee’s capacity or fitness to perform the job properly; and prohibiting an employer from taking a retaliatory action against an employee who declines to undergo a certain medical procedure.
why icm SUPPORTS HB1045
- This bill seeks to establish baseline protection of Maryland citizens' fundamental human right to determine when and if any elective medical procedure is right for them. Medical treatment is a fundamentally private matter; no elective procedure or intervention should be required to obtain or maintain employment.
- This bill seeks to address and preempt a phenomenon we have already seen occurring in Maryland during the Covid-19 pandemic: the bill protects employees against retaliation from their employer if they choose to decline an elective medical procedure or intervention. The bill would also restore protection of employees' fundamental right to privacy with regard to their health and medical status.
- Since several Covid-19 vaccines were licensed for use under the Emergency Use Authorization FDA provision in late 2020, many private and public employers have sought to compel their employees to take the vaccine if they are eligible. Many employers have failed to disclose to their employees that vaccines cannot be mandated under EUA, and their job cannot legally be at risk if they decline the vaccine. This bill would provide a direct remedy to those employees.
- This bill could provide a potential remedy to employees who are currently required to use masks or other protective equipment or practices in the workplace which, according to the strongest scientific evidence currently available, have no demonstrated benefit to employees or the public, and do not prevent viral transmission or lessen the severity of illness.
